5th Post: Scandal, Another Burglary, Health Concerns & Updates

As the OC Register compared,
PROJECT  PROMONTORY
is similar to a WAR  ZONE
&
SCANDAL
BREAKS  AT  THE "ISLAND HOTEL"

Hello Fellow Residents...

Thank you for your support and would like to
share some of the following reports posted by
your neighbors and looking forward to
receiving more!!

IT'S AIRBORNE...

DUST,  DUST  &  MORE  DUST!!

A significant amount of dust has permeated through the windows and door jambs of the units under construction.  In fact, construction crews are wearing protective air masks, in compliance with OSHA regulations but, the residents are not protected.

Residents come home to a layer of thick dust on a daily basis and they are without a means to protect their lungs from the inhalation of dislodged micro-particles, making them vulnerable. Unaware of updated air quality testing, the long lasting repercussions are unknown.

The media recently toured Promontory Point, trekking through the chalky haze and scaffolding.  Upgrades turn Promontory into a “war zone” (as the Register called it), and definitely newsworthy of a very unhealthy airspace.

This observation was not meant to minimize the devastating realities of an actual war zone however, their visit was compounded by the extreme decibel level made by the jackhammering and intense pounding which had an overwhelming eerie impact, to say the least.

At the end of the day, the media staff felt sincere compassion and even stated they wouldn’t want to live here during this project.

WANTED:

CAR WASH SERVICE

Access to quick drive-through wash would be a welcome addition to this project.  Although a petty issue to bring up, it has been increasingly irritating to deal with dirty cars on a daily basis.

It's not just the time consuming task or a  scheduling factor to wash our cars but, let's face it, it adds up!  If you are in a construction zone, you will not be able to maintain a clean car and pettiness aside, it will become very costly to wash cars several times a week.

The Irvine Company has many connections and wouldn't this be a welcome service to offer residents or, are dirty cars just another minor inconvenience?

Just a reminder if you got an A/C unit:  you may want to bypass that window’s sensor or move the sensor and re-set your alarm.  Also, put a dowel or one of those metal shower curtain spring-loaded curtain rods in the window track to prevent the window from being opened. (Note: if someone wants to get in, they could, but why make it easy for them?)

(Posted by Resident)

Of course, now I have to concern myself with safety. One must keep in mind that with these A/C exhaust panels come a degradation of security.  The exhaust panel is in my front window, above a geranium flower planter. [My unit is one flight up from the street, over my garage.]  Not likely someone would come in that way, but still. And now I have to decide whether I need to bypass that window when I set the alarm, or not. It’s this simple stuff that’ll drive you batty.

TRADE  OFF  FOR  HEALTH?

My husband and I have asthma and suffering from asthma related breathing problems the last month. We've been puffing on our inhalers with no avail. I work from home occasionally and the noise level is ridiculous, I can barely concentrate and they haven't even started on our house or
section yet, but the noise is coming from across the pool area so three months is not an adequate timeframe that they are giving us.

After a few weeks we have had to request for an air purifier but that hasn't helped our breathing, I can't even imagine the damage its doing to my child's lungs. The piles of dust are pretty thick in our house even though my windows are closed all day, and as said before, they haven't even started construction yet on our home.

We just had the scaffolding put up in our section this morning so we are feeling the ill effects of the construction even before it starts on our area. I voiced my complaint to the office and asked for more concessions but was told sorry, nothing else we can do, if you can't deal with it you are not held liable to your lease. We just received a lease renewal for the end of December, with a $200 rent increase, so even while the construction is going on, they are still raising rents. Its a wonder why I see moving trucks on a daily basis now.

(email from Resident Website)
This certainly sums it up.  Yesterday evening when I returned from work there was a 1/4 pile of fine dust under my front door, not to mention it everywhere in my apartment.  Not only is it filthy, but god only know what is in that dusk.  TIC admitted at their chicken dinner there a asbestos that is being re mediated from the work being done.  This just isn't right!

(Resident Comment)
The Management needs to be more pro-active and do everything they can to remedy the frustrations most are feeling. IC has many resources and the very least they could do would be to secure appropriate pet care accommodations.

Most of us pay $50 a month per/ animal and they can't be in the units due to the decible level caused by the drilling and cannot be closed up. Animals need and should be vacated during the drilling and pounding process and if you have read other comments, the animals are not handling this very well at all.

IC has no consideration regarding our welfare nor our family pets. Maybe its best to move but who can afford that? This is a horrific mess and hope the resident committee can make progress soon!

Thank you for the photos on new blog & for all of the information. It is sad to read what others are going through. We will be at the meeting.

(Resident Comment)

I am having severe allergy symptoms from this... My sinuses are going crazy, and my throat is closing. There is a very thick white powder with large chunks in it allover from just one day. PLEASE take a baggy and put yours in, so we can have this tested. This is getting into my pet water and food... this cannot be healthy. I am going to bag up a bunch, and have taken pics from just one day. And, we live next to the construction... they have not started our unit. Honestly, I feel like I have the flu, and it is very hard to breathe...

"ANOTHER" BURGLARY
IN PROMONTORY POINT

A reference on the NBPD incident website
reported another burglary around the 400E section of Promontory which makes the rise in reported break-in's to 4 residence and 1 attempted.

Residents have legitimate concerns for safety and due to the long-term scaffolding being accessible at ground level posses a serious problem.  According to the last meeting, the IC Project Manager stated that the scaffolding schedule will not be changed but offered no answers regarding our safety.

WE  HEAR  YOU...

(email received to Resident Website)
Dear Residents of Promontory;
I wanted to comment on the Island Hotel dinner/town meeting sponsored by the Irvine Company. Feel free to use whatever you want from my comments below.

1) Considering the extent (duration, project size) of the construction and the overwhelming response by the residents, I was shocked to hear and see that not one person on the panel was a decision maker!! This was disgraceful and demonstrated a complete lack of respect for the residents of Promontory.

2) While many of the people who spoke at the meeting got off track a bit (discussing the fitness center, etc), I believe there were a couple of key points that were missed in the meeting:

a) Air quality - again, the report that was given to the AQMD was from 2011. Why have there not been more samples being taken? After telling us at the meeting that "asbestos in no near sliding doors or patios" I found out Friday that the 'mud' tape around the sliders contains asbestos and that the IC has had to now hire an abatement team to remove that tape. However, according to the construction office, it is safe for us to remain in our apartments. What??!!?? What about those people with already compromised immune systems? And why is this not common knowledge??

b) Emergency access was not addressed entirely. Neither was parking.

c) We were told that we would be put up in a hotel while the catwalks were worked on. This was not even mentioned.

d) The question was asked and answered about the process of the reconstruction itself. Why are they working 'football' style and not containing the construction to one area and finish in a shorter period of time? The answer was that the project would be drawn out to over 5+ years (ridiculous!) and that the stucco application would not be uniform. Huh? Well it won't be anyway because there is no way that the will re-do ALL the stucco in one day. Crazy!

e) They confirmed that the scaffolding is up for the DURATION of the project. That means for at least four months I am surrounded by scaffolding; safety concerns, privacy issues, loss of patio. A relative reduction to the square footage of lost seemed reasonable. Yet we were told there will be no further consideration given to rent reductions, regardless of the size of your unit, your current rent, the fact that some people will be inconvenienced by the construction (a la West side) for much longer than four months.

f) If they really cared about what we had to say about the project why then were there:

* no notes taken
* no recording made
* no one in authority present

A complete waste of time.

SCANDAL  at the  "Island  Hotel"...
Newport Beach police took hotel freebies for favors, lawsuit claims

By Adolfo Flores
October 3, 201312:46 p.m.

A former parking control officer said he was fired from the Newport Beach Police Department for reporting that senior officers were receiving free suites, spa days and alcohol from a high-end hotel in exchange for favors, according to a federal lawsuit.
In his suit, Zachary McEligot alleged that the Island Hotel in Newport Center would give officers freebies worth thousands of dollars in exchange for easing the license process for massage therapists and turning a blind eye to parking violations.
Officers would also ask hotel security to destroy surveillance tapes, according to the lawsuit filed Sept. 23 in U.S. District Court in Santa Ana. The suit, which names the city of Newport Beach, was first reported by the OC Weekly.
The police department declined to comment on the allegations, but Newport Beach City Atty. Aaron Harp said the lawsuit is without merit.
“There’s no evidence there was any wrongdoing by any members of the Newport Beach Police Department,” Harp said.
“People who are disciplined by a government or city, rather than take personal accountability for their actions, look for some other reason for why they were disciplined.”
McEligot said the tip for the alleged wrongdoing came from a spa director at the hotel, and that he believed the information was true when a department captain told him and another parking officer not to enforce violations at the hotel, the suit alleges.
The suit said the police department launched an investigation after he made his allegations, in which he reported the former police chief, a captain and other officers to his superiors.
McEligot, a 14-year employee, said he was soon the victim of retaliation and was wrongly suspended, the victim of negative performance evaluations and ultimately fired in October 2012.
“It is clear that defendants sought to terminate [McEligot] in retaliation for his disclosures of illegal activities by high ranking members of the NBPD,” his attorney Joseph Avrahamy said.
A now-retired Newport Beach police captain, James Kaminsky, was fined $1,000 in 2010 by the state Fair Political Practices Commission, which concluded Kaminsky failed to report more than $1,200 in gifts from the Island Hotel and others between 2007 and 2008. The commission said the captain received free lodging, spa passes, meals and tickets to a Chicago Cubs game.
The city has not filed a response to McEliot’s lawsuit. The Island Hotel did not have an immediate response.

  2. What the heck does the scandal story have to do with this construction project? And what the heck are people worried about with regards to scaffolding and security? The people who live on the ground floor have had windows accessible to people walking by for years, I don't see them whining about it. In fact, if anything, the new windows will be FAR safer and secure, if we'd just hurry the project along. I just got a letter allowing for 25% rent discount instead of $500. That's another $200 a month off for me. Woohoo! I'm so glad so many people are moving out, this is great news. Not only will it increase vacancy dramatically reducing pressure to increase rents on the ones who stay, and the vacant units are getting ripped up and refurbished, increasing those units' rent dramatically, bringing in even higher paying residents and reducing the riffraff that comes from rents being too low. Perfect, and, as a bonus, I've never seen so much available parking...

    1. Be careful what you wish for. You see, with more vacancies the IC has to cover the loss. That is done by raising your rent with your next lease.

Not so sure about more "available parking."

You also should know that those people who rent units with windows one story or more above the ground, do so because they want an extra layer of security. So your statement about ground floor people being used to it and with no problem is like comparing apples to kumkwats.

Lucky you.....$700 more in your pocket for a few months. Meanwhile, even if they give me my rent free and PAY me $700 on top of that, I'm still losing income because it's impossible to work with all the disturbances.

Why don't you and I trade places for a week?

      Delete
    2. Why dont you move out? Not to be rude but if I couldnt make a living due to the construction than why would you stay?

      Delete
    3. Oh, I will be moving out. The headache now is finding another place. The prospect of moving is daunting.

    4. If you want to rent a house in the area, the "for rent" signs go up in front of the houses on Friday afternoons. The signs don't stay up for very long. Strike while the iron's hot.

    5. Dear Anonymous Oct. 24 @ 5:09pm:

Creation of the "Resident Voice" website was prompted by the construction project because of the challenges it posed to residents and has proved to be a valuable resource. Resident meetings are always open to everyone along with opportunities to participate. In regards to the construction project, as a committee, we support necessary improvements and although they are long overdue, rennovations were welcome.

However, it was is the execution and level of disturbance that turned our community inside out. For all intents and purposes; the Irvine Company admittedly "misjudged" our community and had little regard for our right to peaceful living or quality of life.

To our point; "Town Hall" meetings should have been held prior to the first jackhammer hitting our walls all day which, would have allowed us an opportunity to ask questions, prepare or move.

In reference to your question regarding the "Island Hotel" scandal... This is a public resident blog and welcomes all topics of news related to the Irvine Company properties. To date, this open forum has been supported and we are also happy to report, only one comment has been removed due to profanity.

An "open" forum also means, communication from the community is welcome regardless is it is positive, negative, construction related or a Coyote warning. More over, the resident Blog has found its "voice" and will continue to grow and be a resource to all that want to participate long after the construction is over which means, well beyond 2015.

Again, the Blog was published on behalf of the residents of Promontory Point to provide a forum and a safe place to communicate. Thank you for participating and look forward to hearing and sharing all of your future views, information or concerns.

      Thank you,

      Project Promontory Action Committee

That thought process doesn't make sense... the concern regarding break-ins affects everyone and especially now with scaffolding everywhere. The ladders and rigging are accessible from ground level which means, any creepy crawler or peeping Tom (or worse) can come right in. Btw: Previous break-ins were not on on ground floor units and in fact, they busted straight through the front door of upper units. Face it, if someone wants in, they will find a way but the scaffolding does not make anyone feel any safer. Aside from a few car break-ins and stolen bikes, PP was generally a safe place to live until this year. Don't be fooled by the golf cart cops and is exactly why this project should have been scaled down so they could focus on one section at a time.

My vote: get in, get the job done and get on with the next group. You won't convince me that this is in our best interest and only way to do it! There are already delays and there will be more because anytime they open a wall up, they face the unknown... this is at the best interest of the IC and the more they impose on us, the better for them. Constructive eviction...make it miserable, allow us to break the lease so they can proceed with full remodel. My lease has gone up for two years in a row and will again. I am reading on this site that I am not the only one who isn't fooled by the numbers... it is our money paying for this and if we do choose to move, it is our money paying for an unplanned move which isn't cheap! Heck, I am moving now and NEVER RENTING IN AN IC APARTMENT COMMUNITY AGAIN.

Go on YELP or submit other reviews so people can be warned. This is not resort style living and insulting to tell me I have no choice and is ok to allow contractors in & out of my living space whenever they feel like it. Its just wrong and there should have been better planning.

They newest saying here in PP, "another one bites the dust" and that couldn't be more literal. We are choking on dust in our apartments, walkways and even in my car! So, I am another one "biting the dust" and moving.

    7. Re 12:02 AM post:

What is it about my post at 7:46 that did not make sense to you?

I am not saying that burglaries aren't a huge concern. After all I was one of the three burglarized in August.

I assume that you're referring to my statement, "You also should know that those people who rent units with windows one story or more above the ground, do so because they want an extra layer of security. So your statement about ground floor people being used to it and with no problem is like comparing apples to kumkwats."

What I am saying is that people on the ground floor are used to having people walk around on the outside and perhaps are on alert for this. People on levels ABOVE the ground floor prefer not to have to worry about people trying to get access through a window.

      Delete
    8. no offense... just meaning & wanted to point out that the scaffolding being up for as long as they are planning posses more threat to everyone, even the penthouses because anyone can climb right up. Thats a huge concern & unfortunately, as you have experienced, a frightening reality. I live ground level & believe me, there is never a comfort zone for those walking around such as; gardner's etc.

We do have a false sense of security here & I think there should be security posted at every section within an eyes glance where there is scaffolding. It doesn't make any sense to have one of those golf cart cops drive by... any good thief, stalker or creepy crawler will wait, duck in the dark and proceed with business as usual as soon as security passes.

If the IC insist on keeping the scaffolding up as it without regard to our safety and will not change the schedule, then they need to provide more and "better" security.

Sorry about your break-in... its gotta be life changing!

      Delete
    9. No offense taken. I should have been clearer in my earlier post.

I totally agree about the scaffolding situation. I honestly cannot understand why they saw the need to put it all up and then let it sit for weeks before they use them. Would have made more sense to decide to work on say 6 units, erect the scaffolding, complete the units, then dismember the scaffolding and reassemble it for the next 6 units. Why they did it this way is beyond me. Maybe they didn't want the inspector out a ton of times. Who knows?

To be clear: WE ALL NEED TO BE CONCERNED ABOUT BUGLARIES. Too many people tend to not be concerned about it. Until it happens to them. EVERY single unit here is vulnerable.

Frankly, if I thought there'd be enough people who would get involved, I would suggest a Neighborhood Watch program. This is an excellent deterrent.

As far as the current security patrol. Well, it's better than nothing.....but then.....I don't know how trustworthy these people are, do you?

About my burglary: I did everything right, according to the NBPD. I had two locks on the front door, and used them both. My windows were shut and locked. I did not use the alarm because the old alarm system here doesn't work. [Fred did, however, immediately install a new alarm system and sensors for me.] I was gone all of 1 hour and 15 minutes. The average burglary is all of 8 minutes. Broad daylight, middle of the afternoon. The burglar was very skilled. And there was a noisy tree trimming vehicle out front. Yes, it's life changing. None of the sentimental items taken can ever be replaced nor can I be compensated for them. They were priceless. I live with a huge metal strikemaster by my door. I WILL take down anyone who looks like he's entering. I am that angry about it.

My point is that it happened to me.....which means that it should be easy to burglarize in a construction zone.

      Delete
    10. Wow... Only gone a little over one hour... That's is a huge eye opener! I don't use the alarm because I have a dog & afraid of it going off accidentally while I am away but, I will not be leaving any doors or sliders open anymore for sure. Why take a chance. Its truly sad to have to live with a big cloud of caution hanging over us but realizing your loss, why take a chance.

I am very supportive of the blog & residents committee and feel they are doing everything they can to work with the irvine company to reduce time on each section as you pointed out and they also have other issues they are working on as well. Its unacceptable and they need to realize that these are our homes and not just a deadline to meet for a pay check.

RE; SECURITY CO: I was literally "backed into" by the security guard named Tony while he was in his golf cart. I stopped him because I was trying to help a couple with a lock out and all he said was, "call the after hours line and ask them." I pointed out that it was late and this couple just drove 9 hours to get here and asked him to extend a little more help. Well, before I knew it, he backed the golf cart up into my knee with a threat to get out of the way and was lock outs were not his problem.

Yes, true story and Tony is still working on our property even after I reported this incident to his Company. That behavior was shocking, especially for a Security Guard working here on our behalf. I just don't have the time to chase down every stupid thing but since you asked, I thought I would share...

      Delete
    11. That is APPALLING about the guard. What does he look like? Did you contact Fred? I'd raise hell. I mean it, I would. That guard is supposed to be working for US!

I understand that the guard probably has no access to keys or even a phone number to help with a lock out. [I don't think I would want them to have access to a master key anyway, would you?] But that rude behavior is incomprehensible.

      Delete
    12. When Tony hit your knee, scolded you and drove off, THAT is against the law. It's called a "hit and run." Make a police report. The police will take care of the matter. By the way, Tony is not a guard. He is part of the construction management team.

      Delete
    13. Thanks but, I am dealing with so many other things in life tl& figured after reporting him to his manager that the would take action. I have not seen him for several weeks until the other night... I MA guessing they might have suspended him or moved him to another property? I will call & follow up but reporting him to the managers at Promontory is like speaking to the air.

Although, I didn't get hurt, his actions were very unprofessional and especially being a security guard, should have acted with more concern to help. It was wrong in so many ways & should have serious repercussions.

The guest that drove 9hrs to stay here were shocked & I think they made a complaint to office when they picked up keys re; the whole incident. Thank you

  4. IC is concerned about the bottom line(revenue/profit$$$) generated from the tenants of PP. Is IC concerned about safety and security? Consider the following: The amount of burglaries in the complex will continually rise. Due to word of mouth (construction site workers). The criminal element always on the look out for this type of opportunity. Your personnel belongings are at "risk".

Security in the evening is driving the golf cart around the facility approximately every 2 hours. Are we safe or is this just the security people checking off the box for IC.

    ReplyDelete
    Replies
    1. Exactly! Well said & very true. The security is weak at best and the IC is only about the bottom line or the scaffolding would be pulled up and the project would be focused on smaller sections. Get in, get the job done and move on!

  5. When I walk my dog around 7PM I do see a guard on the golf cart and he does go into the little parking inlets and well as drive on the main road. But really, what can you see without night vision goggles? Still, better to have the "presence" than not.

I think the IC should have erected better lighting in the area. It's pretty dark out there at night?

Question: Who actually moved the patio furniture? Construction guys or ??????

Also, if someone THINKS their green awning is in a storage pod, it may not be. One has been lying on the ground next to a pod for over a week that I'm aware of.

  14. : Our trainer, Sue Myles, told us about an excellent daycare/boarding place here in NB called “The Vet’s House” – owned by a veterinarian and located up in the county area of NB, just south of the 73 off Santa Ana Ave. It’s not a Taj Mahal but the property was clean and I was really impressed with the staff and how they handled the dogs. They have a number of “special needs” dogs there [paraplegic, another with seizures…..] and the attention they get is wonderful. I gave them no notice of my arrival, just showed up on their doorstep. I am going to take Zsa Zsa there for an hour or so tomorrow just to see how she does.

  15. It is flat out reprehensible what is happening here at Promontory Point. The air we're breathing now we WILL have to pay for years down the road and by then it will be too late to punish the Irvine Company for the crimes they've committed against us. We have a baby who's been coughing and crying throughout the day and we are not in the place financially to break our lease otherwise we would. Regardless, breaking leases does not pose a threat to the Irvine Company. They will only make up the difference by raising the rent when they are finished. It's time we ban together as residents and bring forth a CLASS ACTION LAWSUIT against the Irvine company. Please begin reaching out to any connections you have in the field so that we can get our own professional inspections of the mold and contaminents in the air and begin building our cases, which will be a SLAM DUNK for any competent law firm. Any short walk will reveal in plain site the black mold underneath the stripped wood panels. The Irvine Company has become an empire by making money off the backs of the defenseless and its time we stand up for ourselves. The only way we can send a message is by bringing forward a CLASS ACTION LAWSUIT against the Irvine Company. 25% off rent is a most ridiculous offer. They should be offering four free months so that we can get our own cheap hotels and have a fighting chance to save ourselves from the asbestos, mold, lead paint, and dust we are everyday bringing into our bodies. WE MUST CONTINUE THIS FIGHT AND NOT REST UNTIL WE SEND THE MESSAGE THAT THE IRVINE COMPANY CAN NO LONGER TAKE ADVANTAGE OF PEOPLE WHO CANNOT DEFEND THEMSELVES.

    1. Has legal action being done against Promontory? If so what is the status?

  17. Now that construction is done in some areas, Promontory Point is using constructive eviction as a way to hike rates up. They are serving notice to tenants that they have to move out for 30 days so that they can do cosmetic remodeling and then force you to sign a lease at market rates - which are as much as 35% higher than current rent.

  18. Where to even begin... Zero to negative stars would be more reasonable for this dump. First of all they lie strait to your face. You get a ceiling fan with your apartment they told me. I said great that will help out on hot days since there is no air here. Well guess what it doesn't work and they won't fix it. The only reason I chose this particular unit is because it had a ceiling fan. BIG LIE. Also I was told you won't have an ant problem because you are higher up!! Another BIG LIE! I had to call Orkin the day I moved in and spend 400 bucks! As opposed to going on and on in paragraph form it is easier to just list them numerically. I am not a complainer and a very laid back individual. This is the most honest review you will find I can promise you that!
I was accused by staff for my dog barking. They said he is lonely and not to leave him outside. The incompetent neighbors complained and blamed me! FIRST OF ALL!!!! THE "DOG" IS MY CHILD! I NEVER EVER leave my baby alone and he doesn't bark at all. WHEN I WAS ACCUSED I WASN'T EVEN HOME THAT DAY AND HE WAS WITH ME AS ALWAYS!! I DON'T FEEL SAFE LEAVING MY DOG HERE ALONE!

The most concerning thing is I am a single female and I have had not once but 3 times a very shady man on my doorstep. Homeless possibly. Followed me once all the way to my door and I ran inside as he approached. I complained to the office and they blew it off and said call security. That is laughable like the security does anything but smoke cigarettes and eat food. They are never to be found. They have one security officer for the entire place! THE IRVINE COMPANY ABSOLUTELY DOES NOT CARE ABOUT YOUR SAFETY AT ALL!! I begged them to switch my apartment 3 times and they said you cannot do that until you have been there for 6 months EVEN AFTER TELLING THEM ALL THE PROBLEMS!! Great after I am RAPED AND KILLED THEY CAN MOVE MY DEAD BODY OVER THERE!!! I am afraid to go out at night and I have never been afraid in my life!
