      Newport residents equate upgrade to 'war zone'

By NICOLE SHINE I ORANGE COUNTY REGISTER NEWPORT BEACH - There's no "home, sweet home" for Newport Beach resident Cheryl Archer.

An extensive renovation has turned her seaside apartment at Promontory Point into a "war zone," Archer said.  Since construction started last month to replace windows, rain gutters and stucco siding, jackhammer noise has made it nearly impossible to conduct her in-home business as an executive coach, the 55-year-old said.  

Outside, her apartment is surrounded by a maze of scaffolding and construction barricades. Indoors, even with all the doors and windows sealed tight, her eyes sting, she said. She's worried about the dust and particles she sees and breathes.  "I just don't know what my health risks are," she said. "You just don't know what you don't know."

The Irvine Co., which owns and runs the 520-unit complex at the corner of Jamboree Road,  Magdalena Thomasson, a Promontory Point resident, looks out onto her ocean view balcony Friday in Newport Beach. The balcony is covered in scaffolding that is part of the Irvine Co.'s remodeling of the apartment buildings, which some residents said have turned their homes into a war zone.

Michael Lyster said,  the company has discounted the rent of Archer and others by up to $500 a month while construction is underway around their unit, and residents can break leases without a penalty, Lyster said. He said the South Coast Air Quality Management District, which signed off on the project, saw no need for air monitoring.  But Archer and others say the Irvine Co. failed to convey the extent of the project, and expected stretch through early 2015.  "They continue to say they understand this is our home," Archer said. "But they don't really understand this is our home."  

In protest, some residents have started a blog to air concerns about contaminants, noise, and a lack of privacy. They've posted construction photos of what looks to them like black mold, animal droppings, termites and rotted wood. Next to some photos, they write questions like: "How safe are the exposed open walls for our long term health concerns?"  Lyster said any mold or rotted wood will be treated, and that the company is addressing individual tenant concerns on a case-by-case basis. The company has scheduled three dinner meetings with residents at the Island Hotel over the next week or so.'

"There was not one word about major construction," she said.  With her compromised immune system, she wouldn't have moved here if she'd known, she said.  In response, Lyster said in an email: "In May, we still were in the planning and analysis stage and had not set a course to move ahead with the reinvestment yet."  Lawson likened the Irvine Co.'s actions to that of a goliath. "It simply isn't right."

Dear Letter to the Editor;



As residents of Promontory Point, we are submitting the following “letter of correction” to the Editor of the OC Register, Current edition, in regards to an article recently published on Oct. 15, 2013.  

The article was written on behalf of residents impacted by a massive construction project.  Although it seems that this reporter did “hear” most of what the residents had to say, there are a few key points missing. 

One major correction: Our "Resident VOICE" Website and Blog was never intended to create protest, but was created with the intent to provide positive, effective communication, and a safe place for residents to voice their concerns and get information.  

On behalf of the project, we all agree and welcome necessary improvements and understand they are required.    However, it is the way the Irvine Company demonstrated a complete lack of regard for residents' homes, quality of life, health concerns, and safety to residents living here.

The AQMD (South Coast Air Quality Department) signed off on the project on the basis of a report from the Irvine Company dated 2011.  Upon dozens of complaints to the air quality and safety issues, the AQMD came out to the property last week and only advised them to "keep dust down."  However, Tran, AQMD Agent, went on record and strongly urged the residents to call the "OC HEALTH DEPARTMENT" regarding what is actually in the dust and potential hazards.

The Irvine Company had to apply for many permits and licenses in order to orchestrate such a project.  That means they had plenty time to hold resident meetings which would have helped to promote "positive effective communication."  Resident meetings were never held until AFTER the website was published in September of 2013.

Upon the second meeting held on Sept. 24, 2013, residents were told,  "planning for this has been in the process for the past year or so."  Additionally, as reported by the Project Manager, "Once the budget was approved, Mr. Bren, owner of the Irvine Company, said,  'GET TO WORK'." 

Understandably, residents are outraged and had no time or warning to move.  The Irvine Company has an agenda and goal to renovate not only the exterior to Promontory Point, but they also have planned to remodel the interiors. Upgraded interiors would generate higher rent and profit. 

The Irvine Company had NO regard for how a project of this magnitude may affect residents in the long term.  Bottom line: who wants to wait 10 years to see what health issues have developed? 

April, whose story was never conveyed, wanted people to know that she is suffering from respiratory issues over the past month and is coughing something up due to the dust.      

The term: "CONSTRUCTIVE EVICTION" has been used and seems to apply in this case and our community wants to express, “There has been no regard for our health, safety, or quality of life.”


Again, OUR RESIDENT WEBSITE / BLOG WAS NEVER A PROTEST BUT, CREATED  AS A FORUM FOR PEOPLE TO SPEAK OUT ABOUT CONCERNS AND GET INFORMATION.  The construction project has been run like a circus with contractors running on planks similar to a race track and jumping from deck to deck!  Until recent meetings, the only answers residents received were extremely "generic" in regards to any specifics.  The majority of the residents concur, they would like the following to be done:


  • One of the following:  $1000 Monthly Rent Allowance, moving expenses paid, or accommodations made to another property which also includes, pet allowances
  • Air Quality testing done and reports made public
  • Construction project to be re-evaluated and executed on a much smaller scale to reduce the negative impact to the quality of life and privacy
  • Safety... by decreasing time the scaffolding is actually at a ground level will help to provide safety and a piece of mind (especially considering recent burglaries
  • Air Purifiers and Air Conditioners to be made available to all residents 

Our "Resident Voice Website" has made significant progress towards  improvements related to emergency access safety.  Additionally, residents now also have access to AIR CONDITIONERS AND AIR PURIFIERS (on a first come, first serve basis and by request only).

As a Resident Action Committee working on your behalf, we reached out to the local News reporting agencies to share our story.  After reviewing the recent article in the paper, we strongly feel, that although the reporter did absorb and report on most of what residents had to say, however, the Irvine Company sugar coated  what is really going on here.

"GREAT COMPANIES ARE NOT JUDGED BY WHAT THEY SAY BUT RATHER, WHAT THEY DO."   


Our decks have been a place to relax, read, eat, enjoy the morning, or take in a sunset.  For others it is a sanctuary for toddlers to play safely, without the intrusion of scaffolding for the next 3 months or more.  And still, for others, it is a place for our pets while we’re away or at work.  

On another serious note, our elderly population, many with respiratory conditions,  were cooped up in 80+ degree weather without access to fresh air or air conditioners. 

The article also did not mention that the pets who live here feel the vibrations and that the decibel thresholds exceed acceptable levels, causing illness and anxiety and a number of residents are now having to board their pets elsewhere.  By the way, each resident pays a $50 per/month pet fee on top of their rent yet, they are now forced to  pay for animal day care during heavy construction which can add up very quickly.

Our deck space, now know as a "Newport War Zone," is not only a place of peace and source of fresh air but in fact, it is an extension of our homes.  

Like Cheryl Archer mentioned in the article, we have a large population of working professionals that depend on the quiet surroundings of their homes in order to conduct business and have already suffered great financial loss due to noise and chaos.  Although the Irvine Company did make accommodations to work from the clubhouse or Day Suite, in all seriousness, how reasonable to expect everyone to drag numerous files and other essentials up and down stairs on daily basis?  

Most importantly, our homes should be a place where a Mother should feel safe to sit down and breast feed her newborn baby in the comfort of her own home without fear of being intruded upon by another contractor on the deck and, if you don't call having an unannounced contractor drop down on your deck unannounced, than frankly, what is?

Our decks are extensions to our homes;  the square footage is built into the rent.  A $500 “rent allowance” does not come close to what we are sacrificing and by law, the Irvine Company is only meeting the minimum criteria of what the law demands during extensive, large construction projects and not the needs of the community.   

Again, we want to thank Nicole Shine for doing such a good job and for sharing our story.  We only hope that some of the information that was excluded will be updated.  Our Website has had over 4,600 visits and almost 300 comments posted and appears this particular community cares.

    Hello,


    I have lived here for over 5 years and after having read the article on the construction project here at Promontory, as well as the letter from the organizer of the blog for the project, I thought I'd offer another opinion.


    It's not that bad.


    The place is 40 years old, and in dire need of repairs. We were told in plenty of time (at least a couple of months) that this project was coming, and given the option to move out with no penalty. We were also given $500 a month off rent for 4 months. I consider this generous, considering they could have just decided to not renew the leases and had the place empty. When I read all the complaints from the people on the blog it makes me sick. First world whining at it's finest. Yes it's loud, but what do they expect the workers to remove the stucco with, Q-tips? What should they put the earthquake straps in place with? Each section will only have to endure the construction for 3-4 months, and the project will last to 2015, but that's for the WHOLE place, not each section. And when I see things like "a mother breast feeding and having men on her patio" I want to yell "CLOSE. THE. BLINDS!"


    It just seems that the residents here are so used to their privileged lifestyles that they can't bear to be inconvenienced or have their views obstructed for even a few months so that their old windows can be replaced or the building made more earthquake secure. I for one welcome the upgrades and don't mind a little noise. I find the workers to be very respectful, and they don't begin until about 8:30 and are done by 4:30.


    So, there is your other sided opinion, from someone who adores living in a place with views of the ocean and walks to Balboa Island that I would never be able to buy, and who will stay here long after the people who don't understand the need to maintain an old building have left...

    1. I guess it isn't that bad for the people who leave the property in the morning and return in the evening.

      Not all of us are able to do so.

      Guess it's hard for you to understand our viewpoint when you don't have to work from your home and meet deadlines and you can't concentrate because of all the noise and there's no where to go.

      I would agree that this comment was written by an IC employee and if you want to be taken seriously, stop with the "whining" innuendos because it is an insult to those truly affected and have valid complaints.

      I would like to add this as a rebuttal to your ill-informed statement and enlighten you to what an "open" forum blog is about. Its about communication and was never intended to be a bashing site. Additionally, you should stick with the facts and hope your input is being offered because you are in the middle of construction otherwise you have no business insulting your neighbors.

      1) First correction: There are several residents involved with the actual content & management of the web site/blog. There has never been just "one" organizer and you would be an even bigger fool if you believe that. There are also others that contributed as originators because they felt so strongly about matters however, have elected to remain anonymous yet, still supportive.

      2) Secondly: There is a dedicated resident committee made up of about a dozen people and also a couple others that contribute from behind the scenes.

      3) As residents, we ALL love and enjoy the life style or we wouldn't be here. Personally, I have not read or observed comments from over privileged, entitled residents but rather, concerned residents with real life experiences to share.

      4) The IC did not fully disclose the depth or reality of the actual level of distuption and issues we would be dealing with and as stated in the very first letter excited in the summer, it was very "general."

      5) Another correction re; blog... Its was called; "RESIDENT VOICE" because it was created by a group of residents and a resource / forum for all residents. Yes, although you are the minority, the blog was intended to provide an open forum to speak openly about issues & share information which includes you.

      So while you are walking the Island or relaxing from your living space, please let us know how you are doing when a contractor lands on your deck and your about 3 months into this without end in sight due to delays.

      Better yet, think of those neighbors that you referred to as "complainers" when you have to continuously clean an unknown substance of dust from the inside your home and suffer from headaches, eye irritation or respiratory problems.

      We hope you continue to enjoy the IC hosted dinners and as naive as you sound, please remember, there are hundreds more that have valid comments to share and deserve your respect.

      Lastly, if it weren't for the "Resident Voice," we would NOT have air purifiers, air conditioners or better access for emergency access, too simply name a few.

      In fact, it is because of the blog and dedication from the committee that progress has been made and working diligently towards more.

      Thank you for you open mind and alternative thoughts. For the record, as stated very clearly on the Website, we agree and support that improvements and upgrades need to happen but, not to this level of imposition. Moving is extremely expensive and not everyone can just pack up & go.

      The project was executed in a very aggressive manner and has had negative impact to many people living here in what used to be a" peaceful" life.

No, I'm not an IC employee, and not everyone who disagrees with the people who complain is automatically an IC employee, that's a cop-out easy way to dismiss the fact that some of us, maybe even a lot of us aren't worried about this project and actually welcome the long overdue improvements that will come of it. I for one am really happy to not have to feel freezing cold air dropping off the single pane windows every winter, and with that the condensation and moisture and mold. Give me my new windows, yes! This place is awesome, the construction will be done sooner than you think, and the reason why I keep posting about whining is because of asinine first world whining statements regarding breast feeding mothers and blocked views...

    5. Let me see......so because I will be unable to work in my ONLY office, will miss deadlines and probably will lose clients.......at a monetary expense that's much greater than a month's rent, you're telling me that I'm whining?

    6. I just read this entire thread of conversation and I still don't understand why people continue to say we are against the improvements because we are upset at the way this project was handled. At the very least, there should have been a meeting to prepare everyone prior to the demo starting. Additionally, with regards to air quality and noise, spend some time on the East side. Its bad. They also did this to benefit their bottom line versus planning it on a smaller scale which would allow them to deal with issues that come up and not leave scaffolding out for months on end.

      The entire community and blog group have all been supportive of upgrades, building improvements etc... its the way its been handled and insulting to those that are truly impacted to dismiss their frustrations.

      I know several people that have moved and each move was well over a $1000. One in particular was a single person and cost $2100 and that was not for packing boxes either. Its expensive to move and turns life upside down but, that is a quicker mess to get through versus this construction.

  2. My husband and I have asthma and suffering from asthma related breathing problems the last month. We've been puffing on our inhalers with no avail. I work from home occasionally and the noise level is ridiculous, I can barely concentrate and they haven't even started on our house or section yet, but the noise is coming from across the pool area so three months is not an adequate timeframe that they are giving us. After a few weeks we have had to request for an air purifier but that hasn't helped our breathing, I can't even imagine the damage its doing to my child's lungs. The piles of dust are pretty thick in our house even though my windows are closed all day, and as said before, they haven't even started construction yet on our home. We just had the scaffolding put up in our section this morning so we are feeling the ill effects of the construction even before it starts on our area. I voiced my complaint to the office and asked for more concessions but was told sorry, nothing else we can do, if you can't deal with it you are not held liable to your lease. We just received a lease renewal for the end of December, with a $200 rent increase, so even while the construction is going on, they are still raising rents. Its a wonder why I see moving trucks on a daily basis now.

    1. So sorry to hear about that and feel really bad for both of you. My Sister has Asthma and was from exposure to mold. You should call the OC HEALTH DEPT. and ask to have whatever test that can be done. According the AQMD, AIR QUALITY MANAGEMENT DEPT, they only monitor dust and the last report provided by the Irvine Company was from 2011. However, the AQMD advised residents to call the Health Department and report this. Its free and they can help.

  3. I, too, have asthma and chronic bronchitis [COPD] and tomorrow morning they are installing an A/c and air purifier.

    No idea how well they'll work, but at least I'll be able to finally close my windows and get some work done.

    1. Please call the OC HEALTH DEPARTMENT to report issues and ask that they come do testing. Especially on the East side. The dust is awful and cant believe we are not provided with updated air quality reports delivered to our doors. This is a large scale project and they need to step up. I sure don't want to wait to find out I have a tumor or asthma from living here. We are moving or I would be more aggressive about this.

      I did read something about using the Ac machine, etc on the newest post. A resident wrote in and had some advise about using them and article is about 1/2 way down...maybe that will help.

  4. To whom it may concern; Went to dinner with & discussed in depth about construction, he is Oncologist & wife specializes in Pulmonolgy. Their advice: get out, vacate no matter who the cost... The expense to lives & health will be significant

    2. No...they are not residents but, we are moving out. They provided enough factual information and medical evidence that it not only educated us but, provided us with more information about what we are dealing with than the Irvine Company did.

      The elements in the dust are significant and should have been discussed with the community prior to construction beginning. We deserved to be educated in regards to the risk and there should be air quality reports posted in the office, emailed or delivered.

      We have enjoyed living here but, after experiencing this, we will never rent through this company again.

  6. I just got the blue flyer at my door. It's disgusting. Words like "Horrible Living Conditions" and "Rent Jacks" and "War Zone" are SUCH gross exaggerations. Whoever wrote this just has it in for Irvine Co. I've lived here for 5 years, I live in the middle of the construction, and yes, it's loud at times, and there's some dust, but it will be over in a few months, they've done a great job reducing my rent. Seriously first world whining from people who have no idea what a real "War Zone" looks like. Dust on cars? Contractors on balconies and blocked views? OH NO! What are people to do? This kind of flyer just bothers me with it's one sided-ness and I thought I'd post here to offer another perspective. I'm glad they're doing this, and I'm glad they're being aggressive about it. I WANT new windows, I WANT new stucco and especially the added earthquake retrofitting they are doing. And guess what, I really don't care if my car is dusty for a while, and when it's done I'll still live in one of the nicest places in the world, and the people who complain really should move out...

    1. Have not read the flyer yet but, you have to be deaf & blind if the construction has not affected you! Our dog is a nervous wreck and our lives have been turned upside down. We no longer enjoy a quiet day at home and have to deep clean on a daily basis because the dust in our home is everywhere... carpets, floors, counters, tables, upholstery, curtains, towels, dog bed and the list goes on.

      No, this is not a war zone but, it is a total mess and NO AMOUNT of rent reduction is worth this!

      We have put our notice in and moving out of this place. The holidays are here and this has been the worst experience. The upgrades to the building and safety issues are important but they should have focused on smaller sections, moved people out... get the job done and let everyone move on with their lives.

      Five months of this chaos is unacceptable and although this is an open blog, your tone and comments regarding the affects this construction has had on the community are disrespectful.

      Its is doubtful you are in construction and another note; if the majority of the community is voicing complete rage and dissatisfaction in regards to how this is being handled, "you" are the minority and wrong. Or, just another Irvine Company employee.

      The company has admitted to handling this wrong and there are some very serious issues that have blown off. Hope you don't end up with Asthma or tumors...

  7. Talking to several,  and many have not received the blue Flyer that went out today with very good info on it.  How Come?  It should go to everyone.

    Just a thought, what about getting a large contractor to come in and give us a good reason why its taking the current contractor 4 months to do a three week job.  That would be good ammo for us with IC  and nice copy for the newspapers, who want some more stuff from us. So I am told.

    For days now, our outside building has been scaffolded and torn up, with no one working on it, again for  "days". No wonder they are taking 4 months to do a three week job.  Some one should start counting the idle days of now work!  It's a MESS !

  9. We are in the 400's East and have not received any blue fliers... Guess it can't be too important! Right?? LOL! This nightmare is making everyone I know crazy! Honestly, this crap messes with your head! The constant noise... the insane dust and health issues myself, and everyone I speak to are suffering from...this SUCKS! Our pets are getting sick... mine have had bloody stool and diarrhea... I'm sure from a combo of the noise, the powdered cement and crap they are breathing, and eating from licking their paws, after walking pretty much anywhere, even though we try to keep our place clean. There are giant white particles everywhere in our place.

  10. The mental toll this is taking on people is horrific! Seriously, this is causing serious depression and stress related issues. Marriages are being affected due to the stress. There is no amount of "compensation" that can make up for the damage caused by the stress due to this construction nightmare. But, hey... we will have new windows! Yeah!!! Divorce, depression and anxiety... but, new freaking windows!!!

    1. Really person??? Mental toll and broken marriages??? That's a little dramatic. I think there are other issues going on with you. Get outside and take a walk to Balboa Island, ride your bike over to the ferry and go to the beach....you will feel much better. We all live in a beautiful location. This will pass.

    1. The stress of the endless noise, invasion of privacy, and construction site chaos is causing a lot of stress and anxiety which causes tension and people are snapping! If you are so perfect, good for you. A lot of us have been affected, and it is taking its toll.

  13. It is flat out reprehensible what is happening here at Promontory Point. The air we're breathing now we WILL have to pay for years down the road and by then it will be too late to punish the Irvine Company for the crimes they've committed against us. We have a baby who's been coughing and crying throughout the day and we are not in the place financially to break our lease otherwise we would. Regardless, breaking leases does not pose a threat to the Irvine Company. They will only make up the difference by raising the rent when they are finished. It's time we ban together as residents and bring forth a CLASS ACTION LAWSUIT against the Irvine company. Please begin reaching out to any connections you have in the field so that we can get our own professional inspections of the mold and contaminents in the air and begin building our cases, which will be a SLAM DUNK for any competent law firm. Any short walk will reveal in plain site the black mold underneath the stripped wood panels. The Irvine Company has become an empire by making money off the backs of the defenseless and its time we stand up for ourselves. The only way we can send a message is by bringing forward a CLASS ACTION LAWSUIT against the Irvine Company. 25% off rent is a most ridiculous offer. They should be offering four free months so that we can get our own cheap hotels and have a fighting chance to save ourselves from the asbestos, mold, lead paint, and dust we are everyday bringing into our bodies. WE MUST CONTINUE THIS FIGHT AND NOT REST UNTIL WE SEND THE MESSAGE THAT THE IRVINE COMPANY CAN NO LONGER TAKE ADVANTAGE OF PEOPLE WHO CANNOT DEFEND THEMSELVES.

  14. I like how employees keep chiming in pretending to be residents. Not sure why you're standing up for a company that pays you a fraction what you could be making with your qualifications somewhere else. Add to the low pay poor vacation time and subpar benefits along with unfair leasing goals in these conditions, and if I were you I'd take this opportunity to find a much happier life with an employer who treats you like you deserve to be treated along with a 401k.
    No true resident dealing with this right now would write anything positive. If you're bored at the office and want to know the truth, come on over to the east side and bring your gas masks, umbrellas, and full body suits. We want to make sure you're safe. For evidence bring your car over here and park it where the residents do. Within minutes you'll have a very thick coat covering your car and then you'll have a bit more of an idea why residents are walking around feeling dizzy with heaviness in their lungs.
